MTM Property Maintenance – Website Terms of Service

1. Services
MTM provides lawn care, landscaping, snow removal, property maintenance, and related services as described on our Site, quotes, invoices, or service agreements.
The specific scope of work, pricing, and timing will always be confirmed in writing (quote, invoice, or service agreement).
2. Scheduling & Weather Delays

Recurring & One-Time Services: Services are scheduled on a recurring or one-time basis.

Weather Delays: Weekly clients are rescheduled promptly; bi-weekly clients may experience up to a 3-week delay during extended rain periods.

Storm Rule (Snow, Rain, Hurricanes): MTM follows the New Jersey “Ongoing Storm Rule.” Services are performed only after a storm has ended and conditions allow.

Timeline: Reasonable completion is within 48–72 hours after storm end, subject to conditions.

Limitation of Liability: MTM is not responsible for re-freezing, icing, flooding, or subsequent weather events after service completion.
3. Payments

Due Date: Payments are due upon completion of service unless otherwise stated.

Prepaid Packages: Must be paid in full before services begin.

Accepted Payments: Cash, bank check (no personal checks), ACH, Zelle, Venmo, and credit/debit cards.

Convenience Fee: Up to 3% may apply for credit/debit cards. No fee applies for cash, bank check, ACH, Zelle, or Venmo.

Sales Tax: All services are subject to New Jersey Sales Tax (N.J.S.A. 54:32B) where applicable. Client remains responsible for all applicable taxes.
4. Refunds, Credits & Service Guarantee

Service Guarantee: If unsatisfied, notify MTM within 24 hours of service. We will return on the next available “Service Resolution Day.”

Refunds: Only issued if MTM cannot reasonably remedy the concern.

Prepaid Packages/Memberships (GreenPass, VIP, etc.): Non-refundable once services begin. Pro-rated credits may apply only if MTM cannot complete services.

Exclusions: No refunds or credits for delays caused by weather, equipment breakdown, access restrictions, or other conditions beyond MTM’s control.
5. Client Responsibilities

Property Preparation: Clients must clear lawns and driveways of toys, hoses, debris, and obstacles before service.

Hidden Hazards: MTM is not liable for damage to hidden items (sprinklers, cables, hoses, or landscaping features).

Snow Removal: MTM is not responsible for damage to items hidden under snow or ice, nor for ice re-formation after service. Snow is directed only to safe/legal areas.

Access: Gates must be unlocked. Locked access that prevents service is billable at the full visit rate.
6. Liability & Indemnification

Insurance: MTM carries general liability insurance as required by NJ law.

Client Indemnity: Client agrees to defend, indemnify, and hold harmless MTM, its members, employees, and contractors from claims, damages, or liabilities arising from:

Pre-existing property conditions;

Hidden hazards;
-
Client’s failure to maintain safe conditions;
-
Acts of God, weather, or third parties.

Limitation of Liability: MTM is not liable for incidental, indirect, or consequential damages. Total liability is capped at the amount paid for the specific service giving rise to the claim.
7. Termination & Cancellation

Notice: Either party may terminate with 7 days’ written notice.

Packages: If a package is cancelled early, client remains responsible for services already rendered.

Access Issues: Missed appointments due to locked gates or blocked driveways are billable at full rate.

Minimum Term: Certain service agreements (e.g., seasonal contracts) may carry a minimum term; early termination may result in liquidated damages equal to the balance of the agreement.
8. Website Use

Ownership: All content, images, and materials on this Site are the property of MTM. Unauthorized use, reproduction, or distribution is prohibited.

No Warranty: MTM makes no guarantee the Site will be uninterrupted, secure, or error-free.
9. Additional Website & Digital Terms
Privacy & Data Protection
By using our Site, you also agree to our [Privacy Policy], which explains how we collect, use, and safeguard personal information. Continued use of our Site or services constitutes consent to these practices.
Electronic Communications & Records
You consent to receive communications from MTM electronically (email, text, or digital invoices). You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing. You may opt out of non-essential marketing communications by contacting support@mtmpm.com.
Age Requirement
You must be at least 18 years old to enter into any service agreement or booking with MTM. By using our Site or services, you represent and warrant that you meet this age requirement.
Photography & Marketing Use
MTM may photograph or video record exterior property conditions (before/after service) for quality assurance, documentation, and marketing purposes. Unless you notify MTM in writing to opt out (via support@mtmpm.com), you grant MTM a royalty-free license to use such media for promotional purposes, provided no personal identifying information is disclosed.
Subcontractors
From time to time, MTM may engage qualified subcontractors to assist in service delivery. MTM maintains supervisory responsibility; however, MTM is not liable for acts or omissions of subcontractors beyond coverage available under its insurance policy.
Force Majeure
In addition to weather-related delays, MTM is not liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to pandemics, labor shortages, strikes, acts of terrorism, supply chain disruptions, utility outages, government orders, or other force majeure events.
10. Governing Law & Disputes

Law: These Terms are governed by the laws of the State of New Jersey, with venue in Middlesex County, NJ.

Mediation & Arbitration: Any disputes shall first attempt resolution by good-faith mediation. If unresolved, disputes are subject to binding arbitration under the rules of the American Arbitration Association.

Waiver of Jury Trial: By agreeing to these Terms, you waive your right to a trial by jury.
11. Updates
MTM may update these Terms at any time. Continued use of our Site or services constitutes acceptance of updated Terms.
12. Operational Clarifications

Service Area: MTM provides services within Central New Jersey and surrounding counties. Additional travel fees may apply for locations outside our standard service area.

Minimum Fees & Charges: Minimum service charges, trip fees, or service call minimums may apply as specified in quotes or agreements.

Property Damage Protocol: Any suspected damage to client property caused during service will be documented and reported by MTM within 24 hours. Clients must report any claimed damage within 7 days of service completion; claims outside this window will not be honored.

Digital/Technical Issues: MTM is not responsible for booking errors, payment processing delays, or communication failures due to technical issues, internet outages, or third-party service disruptions.

Seasonal Service Transitions: Services transition seasonally (e.g., lawn care to snow removal). Gaps may occur during off-season periods. Clients will be notified of seasonal schedule changes in advance.
